Just recall the biblical story of Prodigal Son. The errant son gets better treatment than others from his father. Many people read but fail to grasp the essence. True essence of this story has far reaching implications. Father in this story personifies the Justice. There is a clear need to treat a criminal, an errant, juvenile delinquent and such others in a radically different manner than that is practiced by the human society hitherto. This is very relevant to today’s society. After all, democracy is all about transforming the wrong into right and vice versa. Meaning of justice and its interpretation itself needs a revamp.
Ancient systems of justice outlived their time and have no place in modern day society. The very concept of Crime and Punishment is obsolete even though the novel with that title retains its charm for the reading public. By punishing a criminal (eye-for-eye theory), we are making him/her a more hardened criminal. If compassion (Lord Buddha style) is shown and a today's criminal is let off, he feels humiliated and thus revolts against the society. The best possible method to address these issues related to criminals is to declare their acts as legal so that they can keep their head high and go about their business! Surely this is confusing and calls for an explanation with an example to avoid any possible misunderstanding.
To illustrate the point, consider the case of Mr A Raja involved in a tiny scam of 1.86 plus lakh crores. A judgement like the follwing makes immense sense:
In the absence of clinching evidence, the charges against Mr A Raja stand summarily dismissed. In all matters related to 2G, 3G, 4G etc,. allocation or otherwise, he firmly and perhaps more rightly than wrongly believed that his political mentor KK is PM cum God (even though his party does not believe in Him). While this court has no jurisdiction on his personal beliefs and value systems, it can not ignore the anomaly that his PM is not same as the one our country sans his state believes to be its present PM. He obtained all clearances from his PM, true to his conscience and made the PM believe that everything is in order in the matters relating to his Ministry. There is no article in our Constitution, which treats this as offence. However, this court believes justice has to be done and it should be clearly seen and made visible that justice has been done. Hence, Mr. A Raja is ordered to clean any one chair in this courtroom in front of full glare of the media, which may be telecasted live on 2G/3G spectrums, with his personal handkerchief for a minute and leave the court room with clean conscience.
Just relax and look at the positives of such a radically progressive and a landmark judgment. This will enter the text books for future law students world over. Daniel comes to Judgment! Our Mr A Raja will not hate the society too much fot his Tihar stint. His party in his native state can continue to be an ally with that national party in forthcoming elections and strive hard to retain their respective seats (remember united we stand theory). Together they can continue their good work in all areas, perhaps more, and more specifically, Raja’s party can use the time-tested methods of 2G and 3G for 4G, 5G, 6G ad infinitum.
